BarcelonaPoint and LudoParks belong to Perfect Sun Travel S.L (CIF B64011497). This last one belongs to the TBD Group and it's located at C/Bailen 20, 3° 3a 08010 Barcelona, Spain.

Legal Framework of the contract and acceptance of the conditions

The client has to know the legal framework applicable to the travel package is composed of the present general conditions and of every specific offer, according to the Legislative royal decree 1/2007 of November 16th (modified with the low 3/2014 of March 27th, approving the revised text of the General Lof for Defense of Customers and Users, as well as all regulations issued in the development of this law about related subjects.

BarcelonaPoint reserves the right to modify these general conditions at any time and without prior notice. However, any changes in the general conditions will not affect bookings made before the modification. Therefore, we strongly recommend to our client to read carefully and to keep a copy of these general conditions before making a reservation.

The terms and conditions apply to all direct or indirect services (through distributors) available online, thanks to any mobile device, by email or by phone. By accessing, browsing and using our website or any of our applications available through the different platforms and/or making a reservation, the customer agrees to have read, understood and agrees to all the terms and conditions shown below. The use of the BarcelonaPoint website, as well as the contracting of any of the services offered in the same, involves the express acceptance of the general conditions appearing next.

If the client contracts specific tourist services, that is to say, not included in a combined trip, the client declares that he also accepts the general conditions of the providing service which will appear in the contracted offer. In case of conflict between our general conditions and those of the provider service in this kind of offer, the latter will prevail.

General conditions

1. Legal capacity to contract

The client declares he or she is on legal age in accordance with the laws of his/her country of residence (more than 18 years in Spain) and that he/she has sufficient legal capacity to contract the services offered by BarcelonaPoint. In addition, the client demonstrates he/she understands all the general conditions set forth herein and that he will use our website and services offered in accordance with the applicable regulations.
Contracts of the services offered in our website must be carried out by persons of legal age.

2. Reliability of the essential elements of the contract

The customer is the only responsible for the accuracy and liability of the data provided to BarcelonaPoint in the booking process because BarcelonaPoint can not verify the authenticity of the data. Details asked to our clients are data necessary to ensure the correct delivery of the services contracted and must appear as listed on the ID or passport. These data are the following: Name and surname, ID/Passport number, phone number, email and country. BarcelonaPoint is not responsible for the consequences arising from the introduction of false or incorrect information during the reservation process and reserves the right to cancel the reservation without prior notice and to take appropriate legal action to take care of its interest in case of fraudulent actions.
The customer is completely and exclusively responsible for correctly establishing the number of passengers that will occupy the accommodation, including children and babies and their respective ages, at the time of booking. The client must be aware that the accommodation can deny entry if the number of occupants at the reception of the accommodation does not match the number of passengers written on the reservation and no claim can be made by the client in these cases.

3. Communications with the client related to the reservation process

BarcelonaPoint communicates with the customer only by email during the booking process.

The Email Confirmation: This email is sent immediately after the booking and contains the essential elements of the contract on the services contracted (type of service, price, details of the accommodation or service booked, board, date of arrival, date of departure, number of persons). The purpose of this communication is to have a writing record with the essential elements of the contract which must be carefully reviewed by the customer and to inform the contact details of the final supplier and at the same time make functions of Booking Voucher.

Confirmations should be used in 2 ways depending on the products or services contracted:
1.- Voucher: The confirmation e-mail must be printed and delivered at the reception/box Office of the place of delivery of the product / service contracted to receive the keys/accesses/tickets and enjoy the product/service contracted on Internet.

2.- Eticket: The e-mail confirmation will send a file(e.g. Pdf) that has to be printed and used in the machines/access points of the place of delivery of the product/service contracted to acces directly to the site and enjoy the product/service contracted on Internet.

If the reservation/purchase has not been carried out correctly, BarcelonaPoint will contact the client via email or telephone according to the information provided in the order.

4.Use and benefit of contracted products/services

The client undertakes to comply with the access and use rules established by each of the premises and establishments.
You must always carry original identification documentation in force as an official ID or Passport that may be required by the staff of the establishment/enclosure of the contracted product/service, as well as timely documentation if you have enjoyed any kind of discount such as youth/student card or large family.
You will not be able to access the place without the previous presentation of the voucher/eticket. The non-presentation of this document will prevent access to the premises. In some cases, the establishments/venues allow the Voucher/Eticket to be printed upon previous return by the customer, but this may entail additional costs indicated in each case in the confirmation email or in the establishment/precinct. In order to resolve incidents, the customer can contact our customer service department by calling +34.93.330.78.60 or by sending an email to contact@barcelonapoint.com in working hours of Monday to Friday from 9h to 17h, outside this time the client has an emergency phone +34.644.71.86.68 during the hours Moday to Sunday from 10 to 22h through WhatsApp.
If the client does not receive the email with the booking documentation during the 24 working hours after completing the payment or before entering the accommodation, you should contact BarcelonaPoint by calling +34.93.330.78.60 or by writing an email to contact@barcelonapoint.com.

5. Inaccuracies or irregularity in the essential elements of the contract

The user is the only responsible for the accuracy of the information provided in the reservation process or the information related to his reservation (type of service contracted, price, name of the accommodation or service, board, date of arrival, date of departure, number of persons). In the event that these data contain typographical errors or are not correct, the user should contact BarcelonaPoint immediately by calling +34.93.330.78.60 or by writing an email to contact@barcelonapoint.com.
In these cases, BarcelonaPoint will make every effort to modify its reservation with the correct information and will not charge management fees for this modification if the notification by the customer is received through the email contact@barcelonapoint.com within 24 natural hours following the receipt of the email confirmation of the reservation. All relevant information on your reservation is detailed in the confirmation email of your reservation which is sent to you immediately after the booking process is complete.

6. The retail price

Prices published on our website are final prices for the entire stay and for all passengers in the reservation and include the corresponding rates. However, local authorities of certain Autonomous Communities of Spain or of other countries can tax our services with additional tourist taxes that must be paid directly in the accommodation establishment by the client. The correct cost of the contracted service must be reported, that is the price of the service per person, detailing taxes.
The price of the contracted service does not include the cost of visas, vaccines, or other optional services of hotels such as parking, laundry services, TV rental and others of similar characteristics.
The client is responsible for complying with the governmental requirements of documentation when travel involves stay abroad.
It is one of the main objectives of BarcelonaPoint, to always offer its customers accurate information and without typographical errors taking into account the means available to them.

7. Types and boards of accommodation establishments

BarcelonaPoint tries to help its customers when comparing the different accommodations in their travel destination in terms of quality and comfort. To do this, it shows the category of the accommodation in accordance with the regulations of each region or country where the establishment is located. The client must take into account that in many cases the quality standards of each region or country are not homogeneous with each other. For this reason, we strongly recommend to our clients to read carefully the descriptions of the facilities of the different accommodations, as well as the opinions provided by our clients and the service providers.
As a general rule, the rooms of the accommodation offered on our website are standard rooms unless otherwise stated in the particular conditions of each offer.
As for the hotel boards, as a general rule each of them contains the following characteristics :
• Room only: includes only accommodation.
• Bed and breakfast: includes accommodation and breakfast.
• Half board: includes accommodation, breakfast and dinner without drinks unless otherwise indicated. The client can only change the dinner for the meal if it is allowed in the particular conditions of the offer and if he/she requests it to the accommodation and he accepts that change.
• Full board: includes accommodation, breakfast, lunch and dinner. Drinks are usually not included unless otherwise stated in the particular conditions of the offer. Usually include the dinner on the day of arrival and the food on the day of departure.
• All inclusive: includes all meals and drinks. See the particular conditions of each offer.

8. Payment of contracted services

The reservation is not formalized until the client pays 100% of the reservation by credit/debit/prepaid card or bank transfer. In case that part of the reservation payment is pending at the beginning of the trip, BarcelonaPoint reserves the right to cancel the booking and will inform the client of this action by email. BarcelonaPoint allows its customers to postpone the payment of their booking without additional cost in reservations without cancellation fees, less than € 100 and made at least 30 days before the arrival date.
For reservations without cancellation fees where the chosen payment method is by bank transfer, the customer will have the time necessary to make the transfer always with an advance of at least 30 days and send to BarcelonaPoint the proof of the payment by email to contact@barcelonapoint.com. That proof of payment is mandatory in order to confirm your reservation, without such payment document BarcelonaPoint will not be responsible for the reservation and reserves the right to cancel the booking (with prior notice by email to the client).

Some accommodations may ask the customer upon arrival his/her credit card number or a deposit as a guarantee of possible payment for additional services consumed in the hotel or apartment or possible damages caused in the accommodation.

In the case the client requires an invoice for the trip booked, he/she must request it once he/she has returned from the trip by sending an email with the name and surname (or company name), ID number, address and booking reference number to contact@barcelonapoint.com.

9. Partial refund to the client for not enjoying the contracted services

BarcelonaPoint shall have no obligation to return to the customer those services which he/she has not enjoyed for reasons attributable to him/her.
In case of not being able to enjoy the entrance for the expected date, the client can modify the date of the same by calling to +34.93.330.78.60 or by email contact@barcelonapoint.com. The Customer Service team will do its best within the conditions established for the contracted product/service and undertakes to respond within a period of maximum 24 business hours after notification with its correct receipt and will start of actions with the suppliers involved.

10. Cancellation policy or modification of a reservation attributable to the client

BarcelonaPoint is an intermediary in the performance of tourist services whose revenues are based on applying a management fee on these tourist services. In order to be able to generate such commissions, BarcelonaPoint incurs advertising expenses to bring visitors to its website, personnel expenses to be able to offer a service that is to his/her liking and a computer applications that allow him/her to make his/her bookings with the greatest possible comfort. These operating expenses are incurred regardless of whether the customer cancels his/her booking and they are greater when the client requests modifications to it. Therefore, and without prejudice to the right of withdrawal that is recognized to consumers and users according to Legislative Royal Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, the client shall not pay BarcelonaPoint any amount for modification or cancellation of reservation as a management fee, without prejudice to the refund of the amounts paid by the client when applicable.
Cancellations of hotel reservations will be subject to the cancellation charges indicated at the time of the end of the purchase.
In cases where cancellation policy has started, it will require the necessary documents to initiate a refund file in case the cancellation is indicated by force majeure. Although BarcelonaPoint will make every effort to obtain refund of the costs of canceling a reservation when it is motivated by force majeure, only the final supplier of the product/service will be the one who can authorize such refund.
Refunds (partial or total) will be made by the same way for which the payment was made, and a new method of return can be requested (bank transfer).
In the event of changes in the reservation, any change will be subject to the availability of the service provider to welcome the client on dates other than those selected at first. These changes may lead to changes in the price of the booking associated with the application of new rates for the period requested that will be determined once the customer communicates his request for modification to BarcelonaPoint.
Any modification or cancellation of a booking must be made in writing by sending an email to contact@barcelonapoint.com. No communication will be valid by phone or other means. These requests will be answered from Monday to Friday from 9h to 17h. Outside those hours, the effective cancellation or modification date will be the next business day. The Customer Care team will do everything within the conditions established for the contracted product/service and undertakes to respond within a period of maximum 24 business hours after the sending of the notification with its correct reception and the start of Corresponding actions with the suppliers involved.
The use of false or incomplete data in the registry or the purchase may entail the user's downgrade and the immediate cancellation of the transaction. Likewise, BarcelonaPoint reserves the right to cancel any operation carried out by users during the purchase process or, even after it is completed, when there are doubts about the veracity of the information provided.

10.1 Cancellation for no show (no presentation)

When making a reservation in an establishment, the client accepts its conditions of cancellation and No Show (if not presented), as well as other additional terms and conditions of the establishment that may affect the reservation or the stay. This includes the services and/or products offered by the establishment (see the terms and conditions at the establishment). The general conditions of cancellation and No Show of each establishment are publicly available on the website, both in the information pages of the establishment and during the booking process and in the confirmation e-mail. The customer should notice that some rates or special offers do not allow changes or cancellations. In case of No Show (no presentation), the tourist tax of the city can be applied. The client can consult the data of each room to see the conditions before making the reservation.
If a delay is anticipated on the day of check-in or if you arrive the next day, the client must ensure that the information is communicated (as soon as possible) to the accommodation, so that, it can be recorded and avoid possible room/reservation cancellations or fees for non-presentation. If you need it, our customer service department can help you inform the accommodation establishment. BarcelonaPoint is not responsible for the consequences that its delay may have or any cancellation or charge for non-presentation that can carry out the accommodation.

11. Overbooking and other modifications to the booking attributable to BarcelonaPoint or service providers

If BarcelonaPoint or any of the service providers are forced to significantly modify any essential element of the contract (hotel, dates, room type, ...), the customer will be informed immediately. The customer will have the power to terminate the contract without any penalty or accept the variations proposed by BarcelonaPoint or by the service provider. In any case, the client must communicate the decision within the period indicated in each specific case. If the client does not make such notification, it will be understood that he/she chooses to terminate the contract without penalty.
In these cases, BarcelonaPoint will make the greatest efforts to offer the client an accommodation of equal or superior category to which he/she had contracted without additional cost, assuming the extra cost associated with the change of accommodation.
BarcelonaPoint never performs overbooking practices but can not control certain providers of the services to offer the carry out of this type of practices at specific times, in these cases applying the conditions seen in the previous paragraph.
In those cases in which refunds of the amounts paid by the customer proceed, BarcelonaPoint will make the return as soon as possible, avoiding that the period exceeds 7 business days, provided that confirmation by the supplier is not necessary from the service that such refund is adequate in which case the period may be extended until receipt of said confirmation. In case the customer has made the payment of his reservation by credit card, the amount will be returned to the account associated with that card. On the other hand, if the customer made the payment of his reservation by bank transfer, BarcelonaPoint will request the customer, the bank account number to which he wants the corresponding refund to be made.

12. Intellectual and Industrial Property Rights

All contents, trademarks, logos, drawings and designs and any creation appearing on the web pages are protected by intellectual and industrial property rights and are expressly reserved for Perfect Sun Travel SL or, if applicable, for the natural or legal persons listed as authors. The violation of the previous rights will be pursued in accordance with the current legislation.
Therefore, the reproduction, exploitation, alteration, distribution or public communication by any title or means of part/the totality of the contents of the web page of BarcelonaPoint for different uses of the legitimate information or contracting by the clients of the offered services. In any case, the prior written consent of BarcelonaPoint will be essential, especially in what refers to the use or copy of the images contained in the websites.
BarcelonaPoint reserves the right to deny or withdraw access to the website and/or services at any time and without prior notice to customers who do not comply with these General Conditions.
BarcelonaPoint makes significant efforts to display up-to-date and good quality photographs and illustrations of the services offered on our website in order to help our customers make the purchase decision with all information available at any time. However, these photographs should not be considered as an accurate statement of the services offered but as an approximation or orientation of the contracted services.

13. Contract file

BarcelonaPoint informs you that the document collecting the contract by means of which the customer acquires any tourist service of our web page will be archived in a database by the travel agency and the customer will be able to access it at any moment by email To contact@barcelonapoint.com.

14. External links and third-party information

On the website there are links to other third-party websites over which BarcelonaPoint has no control and of which it is not responsible. These links are only offered for informational purposes for the customer.
In addition, BarcelonaPoint will not be directly or indirectly responsible for the information entered by customers or collaborators, especially on the valuations that they make on the accommodation.

15. Security and safekeeping of access keys

Once the customer makes his/her booking he/she will receive a booking reference number in the confirmation email. With this booking reference number and the email address provided at the time of booking, the customer will have access to the "Customer Zone" area where he/she can see the summary of his/her booking. The customer must carefully keep the booking reference number, because it is a key of a personal and confidential nature, being the user responsible for the use that a third person makes of it.

16. Browser and operating system

The BarcelonaPoint website is optimized for use with the major browsers available (on Windows, Mac or Linux operating systems).
BarcelonaPoint will make every effort to ensure the availability and accessibility of its services. However, it is not responsible for the inability to use the services offered on our website due to the defective configuration of the client's computer, due to the insufficient capacity of the computer to process the computer systems of BarcelonaPoint in order to use the services Offered or difficulties that may be caused by a poor connection to the Internet.
In any case, our customer service team will help you, as much as possible, to see, complete, book or print what you need to enjoy the products / services you want to purchase or have purchased through the web.

17. Jurisdiction and Competent Courts

The client, regardless of his / her country of residence, accepts that the law applicable to the contract governing the contracting of our services is Spanish. The Judges and Tribunals of the domicile of the "consumer" shall be competent to hear disputes arising from the interpretation or application of these General Conditions, in accordance with the provisions of Legislative Royal Decree 1/2007, of November 16, Which approves the Consolidated Text of the General Law for the Defense of Consumers and Users. In case the client does not have the status of "consumer", the courts of Madrid will be competent. The provision of contracted services will be regulated according to local and state legislation in each case.
If any clause of these General Conditions is declared totally or partially null or ineffective by the competent Courts, said nullity or ineffectiveness will only affect the clause or the part of it that is null or ineffective, remaining otherwise in all other Conditions General. The clause or part thereof which is affected by the nullity or ineffectiveness shall be deemed not to have been.

Both treatment and use of personal data provided by the customer to BarcelonaPoint are included in the section "Information about cookies from BarcelonaPoint.com" of our website which also forms part of these General Conditions.

19. Data Protection and Privacy

Without prejudice, the personal data the user can provide in accordance with the general conditions of booking tickets, BarcelonaPoint obtains and retains all the information provided in the booking form.
In compliance with the provisions of Organic Law 15/1999 of 13th December on the Protection of Personal Data, we inform that any communication addressed through the BarcelonaPoint website will entail the processing of the sender's personal data in a file owned by BarcelonaPoint in order to manage the reservations, the consultations and all those matters related to the purchase. Likewise, we will send you by any means, including the electronic, information regarding the offers and commercial developments related to the website.
We inform you that you can exercise your rights of access, rectification, cancellation and opposition by sending a written communication attaching a copy of your ID or an official document proving your identity to the above address or to the email contact@barcelonapoint.com.
BarcelonaPoint undertakes to treat your data with complete confidentiality, applying to the equipment where your personal data is stored the provisions of Royal Decree 1720/2007 approving the Regulation to develop the law of protection of personal data.

20. Complaints

In case the customer wants to make a complaint to BarcelonaPoint or against any of the service providers, he/she should send an email to contact@barcelonapoint.com. The BarcelonaPoint team undertakes to respond within a period of maximum 24 business hours after dispatch of the claim with its correct reception and initiation of corresponding actions with the suppliers involved.

21. Disclaimer

Subject to the limitations set forth in these terms and conditions, and to the extent permitted by law, BarcelonaPoint is only responsible for direct damages suffered by the customer, paid or incurred by defects attributable to BarcelonaPoint's obligations in reference to our services, up to a total amount of the total cost of your reservation, as indicated in the confirmation email (either by an event or by a series of events).
However, and to the extent permitted by law, neither BarcelonaPoint nor any of our directors, employees, representatives, subsidiaries, affiliates, distributors, affiliates, licensees, agents or other persons involved in the creation, sponsorship and promotion of the website and its contents will be responsible for:

(i)loss or punitive, special, indirect or consequential damages, losses of production, profits, revenues, contracts, as well as losses or damages of customers or reputation and loss of claims;
(ii) errors related to the description of the information (including information on prices, availability and classifications) of the establishment on our website;
(iii) services provided or products offered by the establishment or other business partners;
(iv) Losses, damages or costs (direct, indirect, consequential or punitive) suffered, contracted or paid, arising or relating to the use, unavailability or delay on our website; or
(v) any kind of injury (personal), death, property damage or other damages, losses and expenses (direct or indirect, consequential or punitive) you may suffer, contract or pay, whether due to acts (legal), errors, infractions, negligence (obvious), deliberate professional misconduct, omissions, breaches, misrepresentation, objective non-contractual liability or (complete or partially) attributable to the establishment, or other business partners (including any of its employees, directors, agents, representatives or affiliated companies) whose products or services (directly or indirectly) are available, are offered or promoted on or through our website, including any cancellation (partial), overbooking, strike, force majeure or any other act beyond our control.

Whether the accommodation in which the customer is staying charges (or has charged) for his room or if BarcelonaPoint facilitates the payment of the price of the room, the client accepts that the accommodation is, for all purposes, responsible for collecting, retention, sending and payment of applicable taxes on the total price of the room to the pertinent tax authorities. BarcelonaPoint is not responsible for sending, collecting, retention or paying taxes on the total price of the room to the pertinent tax authorities.
By uploading photos or other images to our system (for example, by sending a comment), the client certifies, guarantees and confirms that he is in possession of the photo/image copyright and that he agrees that BarcelonaPoint uses that photo or image in its websites (mobiles), apps and promotional materials (online and offline), as well as in any publication that BarcelonaPoint considers appropriate. The customer is guaranteeing BarcelonaPoint a non-exclusive, universal, irrevocable, unconditional and permanent right, as well as the license to use, reproduce, display, make reproduce, distribute, sublicense, communicate and facilitate the photos/images in the way that BarcelonaPoint considers appropriate. By uploading these photos/images, the uploader accepts legal and moral responsibility on all and each legal claims made by a third party (including, but not limited to, the owners of the accommodations) as a result of the use and publication of photos/images. BarcelonaPoint does not own or endorse in any form the photos/images uploaded. The veracity, validity and right of use of all photos/images will be assumed by the person who uploaded the photo, and will never be the responsibility of BarcelonaPoint. BarcelonaPoint disclaims any responsibility or liability for the published pictures. The uploader guarantees that the photos/images do not contain any virus, trojan or infected files, as well as any pornographic, illegal, obscene, offensive, objectionable or inappropriate material, and that does not infringe the rights (intellectual property, of copyright or privacy) of third parties. Any photo/image that does not comply the mentioned requirements will not be published and/or may be removed by BarcelonaPoint at any time and without prior notice.

22. Variable or incorrect information

Currency exchange is only informative. It does not show a precise or up-to-date amount, since exchange rates may vary.
Obvious errors (errata included) are not binding.
All special offers and promotions are marked as such at all times.

23. Free service and minimum price guaranteed

We want you to pay the lowest possible price for your stay in an accommodation. If after making your booking with us, you find your accommodation on internet with the same booking conditions and at a lower price, we’ll match the price according to the terms and conditions of minimum guaranteed price.
Perfect Sun Travel offers the best prices on its website. If you find the same accommodation, under equal conditions, for the same dates as your booking in Perfect Sun Travel, after a maximum of 24 hours of making your booking, we promise to match the price or if not we will refund the difference without cancellation fees or additional charges.
To request the refund by minimum price guaranteed you must follow the steps marked below:

1 - Book and pay your reservation on our website.
2 - Send us the following information:
a. Full name as it appears on the reservation.
b. Email as it appears on the reservation.
c. The name and URL of the other web page.
d. Url where you can find the other offer.

When we verify that the accommodation on the other website is available and it is possible to book, we will refund the difference.

24. Unsubscribe from database

In order to delete all your persoanl details from our database, please send us an email to db@ludoparks.com
It will be done in a maximum period of 72 hours.

25. Miscellany

Insofar as permitted by law, these terms and conditions and the provision of our service, shall be governed and construed in accordance/according to Spanish law, and any controversy that arises/ arising by these terms and general conditions or by our services will be presented only in the competent courts of Barcelona, in Spain.
The original version in Spanish of these terms and conditions has been translated to other languages. The translated version is a courtesy and unofficial translation, therefore, no rights can be extracted from the translation. In case of dispute over the content or interpretation of the terms and conditions, as well as in the assumption of conflicts, contradictions or discrepancies between the Spanish version and the other versions in other languages, the Spanish version of these terms prevails and is conclusive in so far as it’s permitted by law.

If any provision of these terms and conditions is or becomes invalid or non-binding, the customer will continue to be bound to the rest of provisions mentioned. If this occurs, the invalid provision shall be enforced to the maximum extent permitted by applicable law and, to the extent possible, an effect similar to that of invalid or non-binding provisions will be accepted, in accordance with the content and purpose of these terms and conditions.
